זכות להגנה משפטית יעילה
הזכות לסעד משפטי היא זכותו של אדם שזכויות האדם שלו הופרו לקבל סעד משפטי. הגנה כזו חייבת להיות בהישג יד לכל ולאפשר :הבאת העבריינים לדין, פיצוי הולם לנפגע ומניעת הפרות נוספות של זכויות האדם.[1][2][3][4] הזכות לסעד משפטי מבטיחה שהפרט יוכל לבקש סעד מהמדינה ישירות ולא באמצעות תהליך בינלאומי. זהו כלי להגנה על זכויות אדם ברמת המדינה אשר דורש מהמדינה לא רק להגן על זכויות אדם דה יורה אלא גם דה פקטו במקרים פרטניים.[3][5][6][7] הזכות לסעד משפטי מוכרת בדרך כלל כזכות אדם באמנות בינלאומיות בנושאי זכויות אדם.[1][2][8][9]
הזכות לסעד משפטי באה לידי ביטוי בסעיף 8 של ההצהרה האוניברסלית בדבר זכויות האדם, סעיף 2 של האמנה הבינלאומית בדבר זכויות אזרחיות ופוליטיות, סעיף 13 של האמנה האירופית לזכויות אדם, וסעיף 47 של אמנת האיחוד האירופי בנושא. זכויות יסוד.[8][1][2][9]
